Other agreements might be added in the case of custom logo design or wesite creation.

The present General Conditions of Use and Sale were written in french in their original version which will prevail and take precedence over any other language version. They applies in their entirety from the 01st january 2021. We will update these Terms and Conditions after every amendment. The most recent version cancels and replaces all of the General Conditions and Terms of Use and Sale which may be previously issued.

The user acknowledges having been informed about the fact that his agreement concerning the contents of the present General Conditions of Use and Sale does not require the handwritten signature of this documen. The user is advised to save and print the present General Conditions of Use and Sale which will prevail between the parts.

The present General Conditions of Use and Sale are effective starting from the date of their instatement online and applies upon the first use of the website by the user. Account: All the information stored on each User, accessible by a login and a personal password. Via his account, the User can manage a set of information that concern him on the website, in particular his personal data, the history of his orders, his projects, etc;
Content: Refers to all the graphic and textual elements provided by the Izeelogo Platform;
Host: Means the KSM-IT Consulting Company, the owner of the Izeelogo website, or its hosting provider (AWS);
User Name: Data which allows the system to identify a person in order to give him access to his Account. Most often it's a unique User Name at the system-wide or a network;
Registration: It is the action of registering on the Izeelogo website. Registration is free and open to any User, natural or legal person;

Platform: Refers to the Izeelogo website which offers Users the opportunity to create and design a custom logo using an online logo generator and/or a custom business card using an online business card creation tool;

User: Refers to any visitor accessing the Izeelogo website and browsing through its various pages, for consultation or use, whether registered or unregistered, natural or legal person.

The Izeelogo website Users have access to various content and functions. The list below is not exhaustive and may evolve over time:

Our paid offers are reserved for people who can legally purchase contracts under French law only. Your Izeelogo account (including your username and password) may not be transferred or passed on to third parties in any form whatsoever.

Registration on our Izeelogo website as a Member is totally free and open to any natural or legal User. This registration implies an unreserved acceptance of the present General Conditions of Use and Sale.

You assume full responsibility for any consequences for not ensuring security and confidentiality. Any Member can decide to close her/his account at any time. Closing the account entails the deletion of all information and content (designed logos, designed business cards, invoices, etc.). However, the Izeelogo Platform may temporarily retain a Member personal data after closure of his account, in accordance with the laws in force.

The establishment of an Izeelogo account is free and without any commitment for all users.

Considering the services provided by Izeelogo ( online logo design , business card design , custom logo design , websites building ), the User must pay the amounts indicated of each transaction. The prices applied to the Services sold are those presented on the izeelogo.com website. In the case of our website creation service, a detailed cost estimate will include the price of the service. Payment must be made by credit card, PayPal or any other payment method authorized at the time of purchase.

Obtaining source files is instantaneous provided that the payment is validated. A notification email will be sent to the Customer to confirm her/his order.

All information provided by the User in connection with a purchase, transaction or monetary operations must be accurate, complete and up-to-date. She/He will pay all applicable taxes, if any, related to his purchases.

The prices indicated on our Izeelogo website do not include taxes, unless otherwise stated.

KSM-IT Consulting makes every effort to keep the Izeelogo website up to date. The prices of our offers may be adjusted according to occasional fluctuations in the exchange market. The customer shall notify us of any billing problem or error within fifteen (15) days of their first appearance on his credit card or bank account statements, otherwise he waives any right of objection.

For Izeelogo, all sales are final, unless otherwise specified. When a User designs, creates, purchases and downloads the source files of a customized logo, they are not eligible to any refund. However, Izeelogo reserves the right, in its sole discretion, to cancel an order and make a refund at any time and as the case may be. Izeelogo reserves the right to modify this policy at any time without notice.

The izeelogo.com website and its elements (moving and still images, sounds, videos, photographs, logos, brands, graphics, text, visuals, tools, software, documents, data, etc.) are the exclusive property of the Izeelogo Platform. By the present, any User of the izeelogo.com website acknowledges and accepts that all programs (in its object code or source code form), data, services, processes, designs, technologies, materials and other elements included in the services are and will remain the unique property of the Izeelogo Platform,of its licensors or of its suppliers and that they are protected by the provisions applicable copyright laws, trademark, patents, trade secret and / or any other right property laws.

You should assume that, unless otherwise specified, anything you see or read on the website is copyrighted and may not be used without our prior written permission. It is the User's responsibility to install security systems and take the necessary procedures to protect themselves from this type of attack.

The User acknowledges that the Izeelogo Platform has no obligation or liability to access brands or services searches to validate the the custom logo ownership or legality. Accordingly, Izeelogo encourages Users to carry out their research independently. Users acknowledge that the Izeelogo Platform cannot have any assistance responsibility inrelating to intellectual property research at a national or international level.

If a User thinks that a content appearing on our website infringes the rights of another party, he is required to inform Izeelogo.

The use of the Website is not exclusive. Other customers use the Izeelogo Platform content to create logos and designs. Izeelogo cannot guarantee that your logo template will not be identical or similar to designs that have been or will be created by others or that your template does not infringe or will infringe anyone's else intellectual property rights. You are solely responsible for ensuring that your design use does not infringe any trademark or someone's else intellectual property rights.

The User must indemnify the Izeelogo Platform from all repair requests from himself and from third parties, following the use of this Website. Izeelogo does not assume any legal responsibility for the use of these logos and cannot be held responsible in the event of recourse, damage or any costs relating to non-compliance with the elements mentioned in the present General Conditions of Use and Sale.

Law No 78-87 of the 25th January 1978, law No 2004-801 of the 16th august 2004, the article L. 226-13 of the Penal code and the European Directive of October 24th, 1995, protect personal data in France. Personal data provided by Users is treated with strict confidence.

The Izeelogo Platform and its host will do their best to prevent any interference, such as loss, misappropriation, intrusion, unauthorized disclosure, modification or destruction of User-Member personal.

The personal data communicated by the Users is saved on the Izeelogo Platform servers or on those of its service providers. Izeelogo only collects and treats information provided by Users. Furthermore, in application of article 1 of decree n° 2011-219 of the 25th February 2011, the Izeelogo Platform has the obligation to keep the data below one year from the content creation, modification or deleting:

The Izeelogo Platform informs Users that there is an extrajudicial procedure settlement relating to a dispute between a professional and a consumer concerning an online service purchase, made available by the European Union .

The Parties remain free to accept or reject the solution proposed by the mediator.

The present General Conditions of Use and Sale and the situations they govern are governed by the French law. Any possible dispute will be submitted only to the French jurisdiction. French law is therefore the only applicable law. All parties recognize that any dispute, whatever it nature or cause is, will be submitted to the competent courts of Amiens depending on the nature of the dispute.

The Customer acknowledges that the communications and computerized registers of the Izeelogo Platform will be considered by the parties as proof of exchanges, orders, payments and transactions between the parties unless proven otherwise.

It is forbidden to use the Izeelogo Platform Services in any territory which does not give effect to all provisions of the present General Conditions of Use and Sale, including in particular this paragraph.
